Welcome to Tracker Logic Inc. (“Tracker Logic”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your use of our GPS tracking, telematics, and related services (“Services”). By accessing or using our Services, you agree to these Terms.
If you are using our Services on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. Services Provided
Tracker Logic provides GPS tracking, telematics, and fleet management solutions, including software, hardware integrations, and related support. Our Services are designed for both individual and business use.
3. Account Registration and Security
- You must provide accurate, complete, and current information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
- Notify us immediately of any unauthorized use or security breach.
4. Acceptable Use
You agree not to use our Services:
- To track individuals without their knowledge or consent where legally required.
- In violation of applicable laws or regulations.
- To infringe upon the rights of others, including privacy or intellectual property rights.
- To attempt unauthorized access to systems, networks, or data.
5. Data Privacy
Your use of our Services is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information.
6. Third-Party Services
Our Services may rely on third-party providers (e.g., mapping APIs, payment processors, hosting). While we work only with trusted partners, we are not responsible for the availability or performance of these third-party services. 7. Service Availability and Updates
Tracker Logic strives to provide reliable, continuous access to its Services. We target 99.9% monthly uptime for our core systems. This target is a goal, not a guarantee, and excludes planned maintenance and events beyond our reasonable control (including internet outages, hardware failures, and force majeure).
We may perform maintenance and updates from time to time. Whenever possible, we will schedule these during off-peak hours and provide advance notice.
8. Fees and Payments
- Subscription fees are billed in accordance with your selected plan and are due as specified at the time of purchase.
- Payments are processed securely through Moneris.
- Late or missed payments may result in suspension or termination of Services.
9. Intellectual Property
All content, software, and trademarks used in connection with our Services are the property of Tracker Logic or its licensors. You may not copy, modify, distribute, or create derivative works without our prior written consent.
10. Limitation of Liability
To the fullest extent permitted by law:
- Tracker Logic shall not be liable for indirect, incidental, or consequential damages arising from the use or inability to use the Services.
- Our total liability for any claim shall not exceed the amount paid by you for the Services during the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Tracker Logic, its affiliates, employees, and agents from any claims, damages, or expenses arising out of your use of the Services or violation of these Terms.
12. Termination
We may suspend or terminate your access to the Services at any time if you violate these Terms or engage in unlawful activity.

13. Governing Law
These Terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada. Any disputes shall be resolved in the courts of Saskatchewan.

We may update these Terms from time to time. The most current version will be posted on our website, and your continued use of the Services signifies your acceptance of any changes.
