This Fair Use Policy (“Policy”) applies to customers of Tracker Logic Inc. (“Tracker Logic”, “we”, “our”) whose service agreements include managed IoT connectivity and cellular data services (“IoT Services”).
1. Purpose of This Policy
The IoT Services are designed to support GPS tracking, fleet telematics, and related business activities. This Policy ensures fair and responsible use of cellular connectivity so that all customers receive high-quality service.
2. Scope
This Policy applies only to customers with managed service agreements that include IoT cellular data provided by Tracker Logic. Customers who supply their own IoT SIMs and data plans are not subject to this Policy.
3. Fair Use Guidelines
The following are considered acceptable uses:
- GPS tracking and location updates at normal reporting intervals.
- Standard telematics data (e.g., speed, engine diagnostics, driver behavior).
- Notifications and alerts related to fleet operations.
The following are considered unacceptable or abusive uses:
- Transmitting large volumes of non-telematics data (e.g., video or audio streaming).
- Using SIMs in unauthorized devices (e.g., personal hotspots, smartphones).
- Excessive polling/reporting intervals outside normal fleet use.
- Sustained monthly usage exceeding 5× the average fleet usage for similar plans.
4. Actions for Excessive or Abusive Use
If Tracker Logic detects usage inconsistent with this Policy, we may:
- Notify the customer and request remediation.
- Apply additional charges for excess data at rates specified in the customer’s agreement.
- Temporarily limit, throttle, or suspend IoT Services until usage is compliant.
- In severe cases, terminate IoT Services under the terms of the customer agreement.
